3. For what purpose do we process your data on these web pages, and on what legal basis?

BECEPTUM collects and uses personal data to provide these web pages as well as our content and services within the requirements of Art. 6 (1) a to f GDPR, i.e. insofar as the GDPR or another legal provision permits this or the user has consented to the processing. With all service providers engaged on our web pages as processors pursuant to Art. 28 EU GDPR, we conclude data processing agreements as required by law, and the providers are subject to an IT security assessment beforehand.

In addition, BECEPTUM processes personal data when you visit this website as follows:

a) Log files

Each time our web pages are accessed, so-called log files are stored automatically on the basis of our legitimate interest pursuant to Art. 6 (1) f EU GDPR. They contain information about the computer accessing our web pages, e.g. browser type, operating system used, internet service provider, IP address, and the date and time of access.

Storing this data is necessary in order to make our web pages available to users for the duration of the session. We also use this data to optimise our web pages and to ensure the security of our IT systems. Log file data is deleted as soon as it is no longer required for the purposes stated (see section 4 for details).

b) Newsletters, mailings, downloads

On the BECEPTUM web pages we provide a broad range of newsletters, mailings and downloads on the basis of the user’s consent pursuant to Art. 6 (1) a EU GDPR, where applicable in conjunction with § 7 (2) no. 3 of the German Act against Unfair Competition (UWG). On the basis of the statutory permission under § 7 (3) UWG we may also send certain information to data subjects by email.

To subscribe to topic-related newsletters and mailings and to download certain BECEPTUM documents (e.g. studies), your name and email address are required. By subscribing or downloading, you also give BECEPTUM your consent to record your future visits to our web pages on a personal basis, so that we can send you topic-related information tailored to your individual interests (e.g. current studies, surveys). For this purpose, a cookie set by our service provider Zoho (Zoho Campaigns, part of Zoho One) records the individual BECEPTUM web pages and topics a registered user views during their visits (see also section 3e below).

After subscribing to newsletters, mailings or downloads on the BECEPTUM web pages, every user receives a confirmation email at the address provided (so-called double opt-in procedure). The registration is only completed once the link contained in this email has been activated.

Consent given for the receipt of newsletters, mailings or downloads can be withdrawn at any time via a link at the end of every email or by sending a message to the BECEPTUM mailbox info@beceptum.com.

Registrations for newsletters, mailings or downloads are logged on the basis of our legitimate interest in being able to demonstrate a user’s registration and consent at any time (Art. 6 (1) f EU GDPR).

If you have not used our offerings in any form for one year, you are deemed no longer interested and will be deleted automatically from Zoho Campaigns.

c) Contact form

To request further information, we provide contact forms at various points on our web pages that allow you to get in touch with us directly. We process the personal data entered there (e.g. name, email address) within the statutory provisions in order to handle your enquiry pursuant to Art. 6 (1) b and Art. 6 (1) f EU GDPR respectively.

d) Cookies

BECEPTUM uses so-called cookies for the purposes set out below. A cookie is a text file sent from the web server to the browser which processes information about the website visitor (e.g. IP address), their settings and the devices used.

Strictly necessary cookies

These cookies are essential to ensure that users can navigate and use certain functions of the website. Without them, key parts of the website cannot be used. Accordingly, these cookies are always active. They are only used when you visit our website and are generally deleted once you close your browser. They are also used to deliver the optimised website presentation when accessed from a mobile device, so that your data volume is not consumed unnecessarily. The cookies also facilitate the switch from http to https, ensuring that transmitted data remains secure.

Functional cookies

Functional cookies enable the website to save the information you have provided, such as your user name or language selection, and to offer you improved and personalised functions on that basis. The information collected is evaluated exclusively in aggregated form.

As we want to provide you with a website designed for optimal usability, we recommend activating these cookies. Functional cookies are also used, for example, to enable functions you request such as video playback.

Performance cookies

These cookies collect data on user behaviour. On this basis, the content and functionality of the website is aligned with general usage behaviour. The information collected is generally processed further in aggregated form, unless a user has expressly and separately consented to a personal evaluation. Performance cookies are used exclusively to improve the performance of the website and to tailor the online experience to users’ needs.

Marketing cookies

Marketing cookies are used to offer content that is more specifically relevant to the user and tailored to their interests. They are also used to measure and manage the effectiveness of campaigns. For example, they record whether or not a web page has been visited and which content has been used. This information is used to create an interest profile so that only content of interest to you is displayed. If you withdraw your consent to marketing cookies, this does not mean that you will subsequently see and receive less content. Rather, it means that the content you see and receive will not be tailored individually to your needs.

Social media cookies

Social media cookies are used to offer content that is more specifically relevant to the user and tailored to their interests. They are also used to measure and manage the effectiveness of campaigns. For example, they record whether or not a web page has been visited and which content has been used. This information is used to create an interest profile so that only content of interest to you is displayed. If you withdraw your consent to social media cookies, this does not mean that you will subsequently see and receive less content. Using this data, BECEPTUM can display targeted advertising outside its website without you being identified as a website visitor.

The legal basis for data processing by cookies is Art. 6 (1) a, f GDPR, i.e. the consent of the website visitor or a legitimate interest of BECEPTUM. A legitimate interest of BECEPTUM in the use of cookies pursuant to Art. 6 (1) f GDPR exists in particular for the use of strictly necessary cookies (see above).

Further detailed information on the cookies used by BECEPTUM can be found in the BECEPTUM cookie settings, where the chosen cookie configuration can also be adjusted by the user at any time.

Please note: if you consent to a category, the cookies are activated immediately or when the web page is reloaded. If you withdraw consent already given for a category, the cookies already set remain active until the end of their lifetime. To ensure that these cookies are blocked immediately, you must delete them manually via your browser settings after withdrawing your consent.

e) Tracking and analytics tools

BECEPTUM uses third-party tracking and analytics tools on these web pages. These use so-called performance cookies, whose use can be adjusted via the settings options of the respective third-party providers explained below or in the BECEPTUM cookie settings. The settings can be adjusted on every page in relation to the domain.

For analytics purposes, BECEPTUM uses Zoho Campaigns, a service provided by Zoho Corporation, on its web pages.

So-called “web beacons” are used and “cookies” are also set which are stored on your computer and enable us to analyse your use of the website. The information collected (e.g. IP address, geographic location, browser type, duration of the visit and pages accessed) is evaluated by Zoho on behalf of BECEPTUM in order to generate reports on visits to BECEPTUM and the pages visited.

If, as described in section 3b), BECEPTUM email news is subscribed to and studies or other documents are obtained, we may, together with Zoho and on the basis of the consent given, link a user’s visits to BECEPTUM web pages with their personal details (in particular name/email address), thereby recording them on a personal basis and informing users individually and specifically about their preferred topics.

If you generally do not wish to be recorded by Zoho, the storage of cookies can be prevented at any time via the corresponding browser settings.

4. How long is data stored?

Log files are deleted automatically after 30 days at the latest, unless they are still required to investigate a specific security incident.

Newsletter and marketing data is deleted as soon as consent is withdrawn, or after 12 months of inactivity at the latest (see section 3b).

Data from contact enquiries is deleted as soon as the enquiry has been finally processed, unless statutory retention obligations (e.g. under the German Commercial Code/Fiscal Code, 6–10 years) prevent this.

5. What data protection rights do data subjects have?

Data subjects have the right to information pursuant to Art. 15 EU GDPR about the processing of their personal data by BECEPTUM (including the purpose of the processing, any recipients and the expected storage period), rights to rectification of inaccurate data (Art. 16 EU GDPR), erasure (Art. 17 EU GDPR), restriction of processing and portability of the data provided (Art. 18, 20 EU GDPR), as well as the right to object to use for marketing purposes and to processing based on a legitimate interest of BECEPTUM (Art. 21 EU GDPR).

Consent once given may in principle be withdrawn vis-à-vis BECEPTUM at any time with effect for the future. To exercise these rights, any data subject may contact BECEPTUM’s data protection officer (see section 2). There is also a right to lodge a complaint with a data protection supervisory authority. Data subjects may address their complaint to the authority of their place of residence or, in principle, to any other data protection supervisory authority.
